Terms of Service
Effective July 3, 2026
These Terms of Service ("Terms") govern your access to and use of the Roadpulse application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Roadpulse
You must be at least 13 years old (or the age of digital consent in your country). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your account
You are responsible for the activity that happens on your account and for keeping your password secure. Notify us immediately at support@roadpulse.app if you suspect unauthorized use.
3. Subscriptions and billing
Paid plans (State, US, Sponsor tiers, and any annual plan) renew automatically at the end of each billing period unless canceled before the renewal date. Prices are shown in USD and processed by our payment provider. All sales are final — we do not offer refunds for partial billing periods. Referral-linked subscriptions carry a two-month minimum commitment as disclosed at signup. You may cancel at any time from the Account page; access continues through the end of the paid period.
4. Acceptable use
You agree not to: (a) upload unlawful, harassing, hateful, sexually explicit, or infringing content; (b) impersonate any person or misrepresent your affiliation; (c) submit false or misleading hazard reports; (d) attempt to reverse-engineer, scrape, or overload the Service; (e) resell or redistribute Service data without written permission; or (f) use the Service while operating a vehicle in a manner that violates local law. You are solely responsible for driving safely — do not interact with your phone while driving.
5. Your content
You retain ownership of the photos, videos, comments, and other content you post ("Your Content"). By posting, you grant Roadpulse a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content within the Service and in promotional materials about the Service. You represent that you have the rights to post Your Content and that it does not violate any law or third-party right.
6. Moderation
We may remove content, suspend accounts, or terminate access at our discretion for violations of these Terms, applicable law, or community safety. Repeat infringers will be banned.
7. Third-party data
Traffic, camera, weather, and location data is provided by third-party sources (state DOTs, Google Maps, weather services, and others) on an "as-is" basis. Roadpulse does not guarantee the accuracy, completeness, or timeliness of any data. Do not rely on the Service as your sole source of safety-critical information.
8. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROADPULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROADPULSE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IN ANY MATTER IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold Roadpulse harmless from any claim, demand, or damages arising from Your Content, your use of the Service, or your violation of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email. Your continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Florida.
